2. Important Disclaimers

Product information

SouthCore aims to keep product descriptions, specifications, images, pricing and availability accurate. Manufacturers and suppliers may change specifications, packaging, colours, dimensions, included accessories or technical features. Product images may be illustrative and may not always represent every supplied configuration.

Pricing and availability

Website pricing and availability may change. Where a quotation is requested, the quotation issued by SouthCore will state the applicable price, validity period, delivery charges and other material commercial terms. An order may be subject to stock confirmation and supplier availability.

Technical suitability

Customers are responsible for confirming that equipment is suitable for the intended application, operating environment, power requirements, site conditions and applicable regulations. Where a customer communicates a specific purpose to SouthCore, SouthCore will consider that information when advising on suitable equipment.

Website availability

SouthCore does not guarantee that the website will always be uninterrupted, error-free or available. We may maintain, update or temporarily suspend parts of the website where reasonably necessary.

3. Client Agreements & Terms of Sale

A sale, quotation, supply agreement or other commercial engagement may be governed by the written quotation, invoice, purchase order, order confirmation, supply agreement and/or other terms accepted by the parties.

Quotations

  • Quotations should be reviewed for product description, quantity, price, VAT treatment, delivery, lead time and validity period.
  • A quotation may expire after the period stated on it.
  • Special-order, imported, customised or supplier-direct equipment may have different lead times and cancellation conditions.
  • Where a written client agreement contains terms specific to a transaction, those terms will apply to that transaction to the extent permitted by law.

Electronic orders

Customers should review order details before submitting an order. South African electronic-commerce law provides requirements around supplier information, transaction review, correction of errors and electronic records.

Business-to-business transactions

Where a customer purchases equipment in a business or commercial capacity, additional quotation, procurement, credit, delivery, installation, warranty or service terms may apply. Any such terms will be communicated as part of the relevant transaction.

4. Data Privacy

SouthCore will process personal information responsibly and in accordance with applicable South African privacy law, including the Protection of Personal Information Act 4 of 2013 (POPIA). POPIA establishes conditions for lawful processing and provides rights relating to personal information.

Information we may collect

  • Name and contact details.
  • Company and business information supplied for a quotation or order.
  • Delivery and billing information.
  • Order, quotation and customer-service records.
  • Information voluntarily submitted through forms, email or other customer communications.
  • Technical and website-use information where tracking technologies are enabled.

Why we use information

We may use information to process orders and quotations, arrange delivery, communicate with customers, provide support, prevent fraud or misuse, maintain business records, improve the website and meet legal or regulatory obligations.

Sharing information

Information may be shared with service providers or suppliers where reasonably necessary to fulfil an order, quotation, delivery, payment, support or other requested service, or where disclosure is required or permitted by law. SouthCore does not sell personal information as a commercial product.

Your rights

Subject to applicable law, customers may request access to personal information held about them and request correction where information is inaccurate. POPIA also provides rights and remedies concerning the processing of personal information.

5. Tracking & Cookies

SouthCore may use cookies, local storage and similar technologies to keep the website functional, remember shopping-cart information, understand website usage, improve performance and support security.

Functional technologies

Some technologies may be necessary for features such as shopping carts, product preferences, navigation and session functionality.

Analytics and marketing

If SouthCore introduces analytics, advertising pixels, remarketing or other non-essential tracking, the relevant technology and purpose should be disclosed and managed in accordance with applicable privacy requirements. Third-party services may have their own privacy and cookie policies.

Managing cookies

Most browsers allow users to control or delete cookies. Disabling certain technologies may affect website functionality.

6. Safe Payment

SouthCore will provide the payment method applicable to the transaction through the checkout, quotation, invoice or other official sales communication.

  • Only use payment details supplied through an official SouthCore sales or order channel.
  • Never provide a SouthCore representative with your card PIN, online-banking password, one-time PIN or banking login credentials.
  • SouthCore will not ask customers to disclose an online-banking password or OTP for the purpose of confirming an order.
  • Before making a bank transfer, verify the beneficiary details against the latest official invoice or confirmed SouthCore communication.
  • If banking details unexpectedly change, contact southcoreequipment@gmail.com through a known contact channel before paying.

Payment information is handled through the payment or banking process applicable to the transaction. SouthCore should not be treated as storing full card credentials unless the applicable payment system and SouthCore's technical configuration expressly provide for this.

7. Delivery

SouthCore supplies equipment to customers in South Africa, subject to product availability, supplier lead times, delivery location, equipment size and the delivery terms agreed for the transaction.

Delivery estimates

Any displayed or quoted delivery period is an estimate unless expressly agreed as a firm delivery commitment. Delays may occur because of supplier availability, manufacturing, importation, transport, weather, site access or other circumstances outside reasonable control.

Customer responsibilities

  • Provide a correct delivery address and reliable contact details.
  • Ensure that the delivery location can safely receive the equipment.
  • Provide any access, offloading or site information requested for larger equipment.
  • Inspect delivered goods for visible damage and record any delivery issue as soon as reasonably practicable.

Large or specialised equipment

Heavy machinery, generators, trailers, refrigeration equipment and other specialised products may require separate transport, offloading, installation or site-preparation arrangements. These requirements and costs should be confirmed in the quotation.

8. Refund, Return & Replacement Rules

SouthCore will process returns and remedies in accordance with applicable South African consumer law and the terms applicable to the transaction. The Consumer Protection Act provides an implied warranty of quality for qualifying consumer transactions, including a statutory remedy framework for defective goods.

Defective or unsafe goods

Where goods fail to satisfy applicable quality requirements, consumers may have statutory rights to return the goods and seek a repair, replacement or refund in accordance with the law. Section 56 of the CPA provides a six-month implied warranty framework for qualifying transactions, subject to the Act.

Incorrect or damaged delivery

If the wrong product is delivered, or goods arrive visibly damaged or incomplete, contact SouthCore promptly with the order number and photographs where appropriate. SouthCore will assess the issue and arrange the applicable remedy.

Unwanted goods / cooling-off rights

Returns of unwanted goods are subject to the specific statutory rights applicable to the transaction, including any applicable electronic-transaction cooling-off rights. The ECTA contains a seven-day cooling-off right for qualifying transactions, subject to its exceptions and requirements.

Return window & change-of-mind requests

For qualifying online transactions, the Electronic Communications and Transactions Act 25 of 2002 provides a seven-day cooling-off period for goods, measured from receipt of the goods. Where that statutory right applies, the consumer may cancel without reason or penalty, and the only charge permitted under section 44 is the direct cost of returning the goods. Statutory exceptions apply, including certain goods made to a consumer's specifications, clearly personalised goods and goods that by their nature cannot be returned.

SouthCore does not impose a separate general "no refunds" rule that removes statutory rights. Any additional return or cancellation terms for a particular product will be stated in the applicable quotation, order confirmation or agreement.

Refund timing

Where a qualifying section 44 cooling-off cancellation applies and payment has already been made, the statutory refund is due within 30 days of cancellation. For approved refunds arising from an incorrect, damaged or defective product, SouthCore will confirm the applicable remedy and refund timing with the customer in accordance with the law and the transaction terms.

Return costs & collection

For a qualifying section 44 cooling-off return, the direct cost of returning the goods may be charged to the consumer as permitted by law. For qualifying defective goods covered by section 56 of the Consumer Protection Act, the goods may be returned at the supplier's risk and expense. Large or specialised equipment may require a specific collection or transport arrangement, which SouthCore will confirm before the return is arranged.

How to start a return or refund request

  1. Email southcoreequipment@gmail.com with the order or quotation reference.
  2. Alternatively, contact SouthCore on WhatsApp at +27 62 598 5902.
  3. State whether the request concerns a cooling-off cancellation, defect, damage, incorrect item or another issue.
  4. Provide photographs, delivery evidence or other supporting information where relevant.
  5. Wait for SouthCore's return/collection instructions before sending large, heavy or specialised equipment back.

Special-order and customised equipment

Equipment manufactured, imported, customised or ordered specifically for a customer may have additional cancellation and return conditions, which will be disclosed in the quotation or agreement. These conditions do not override rights that cannot lawfully be excluded.

How to request a return

  1. Email southcoreequipment@gmail.com with the order/quotation reference.
  2. Explain the issue and provide photographs or supporting information where relevant.
  3. Do not repair, modify, dismantle or alter the equipment before SouthCore or the applicable supplier has assessed the issue, unless necessary to prevent immediate danger.
  4. Follow the return, inspection, repair, replacement or refund instructions provided by SouthCore.
Important: Normal wear and tear, misuse, negligence, unauthorised modification, incorrect installation or operation contrary to manufacturer instructions may affect a warranty or remedy where permitted by law and the applicable warranty terms.

9. Contact, Complaints & Legal Queries

We encourage customers to contact SouthCore first so that an issue can be investigated and resolved efficiently.
